ASSEMBLY HOUSE BILLS HB 24 VILLAGE DISSOLUTIONS (Wolpert) Am. & En. 703. Permits the board of county Commissioners to dissolve a village under certain conditions. The bill becomes effective August 29, 2003. HB 40 BUDGET CORRECTIONS (Calvert) Am. & En. 4301, 4305, 5104, 5139, 5741 & 5743. Makes program and budgetary modifications, increases the rate of tax on cigarettes and alcoholic beverages, makes other tax modifications, and makes an appropriation. The bill has been signed by the Governor and became effective March 7, 2003. HB 58 TAX REFORM DIRECTIVE (Kilbane) Directs the General Assembly in its deliberations regarding the enactment of reforms of the state's tax laws. The bill has been referred to the House Ways & Means Committee. HB 87 TRANSPORTATION BUDGET (Buehrer) Am. & En. 4501, 4503, 4505, 4506, 4507, 4511, 4513, 5501, 5502, 5517, 5525, 5531 & 5735. Makes appropriations for programs related to transportation and public safety for the biennium beginning July 1, 2003 and ending June 30, 2005 and provides authorization and conditions for the operation of those programs. The bill is effective March 31, 2003. Certain provisions effective 6/30/03 and 01/01/04. HB 94 CIVIL SERVICE (Buehrer) Am., En. & Rep. 9, 119, 124, 302, 325, 329, 1513, 4111, 4112, 5107 & 5155. Implements the recommendations of the Civil Service Review Commission. The bill has been referred to the House Finance & Appropriations Committee. HB 95 BIENNIAL BUDGET (Calvert) Am., En. & Rep. numerous ORC chapters. Levies taxes and provides for implementation of those levies, makes operating appropriations for the biennium beginning July 1, 2003, and ending June 30, 2005, and provides authorization and conditions for the operation of state programs. The bill was signed by the governor 6/26/03. Certain provisions effective on other dates. Said dates have not yet been published.
HB 98 PENSION FUND OPTIONS (Willamowski) Am. 145, 3105, 3307 & 3309. Makes changes to the option benefit plans for retirants and the cost-of-living increases in the Public Employees Retirement System, State Teachers Retirement System, and School Employees Retirement System. The bill has been assigned to the Senate Health, Human Services & Aging Committee.
HB 109 MUNICIPAL INCOME TAX CREDIT (Schaffer) En. 718. Requires municipal corporations with more than $100 million in annual income tax collections to provide a tax credit to nonresident taxpayers. The bill has been referred to the House Ways & Means Committee.
HB 114 EMPLOYEE RESIDENCY REQUIREMENTS (Flowers) En. 9. Prohibits political subdivisions from imposing residency requirements on certain employees. The bill is pending a floor vote in the House.
HB 127 TAX-DELINQUENT PROPERTY (Jolivette) Am. & En. 5722. Permits municipal corporations to acquire tax-delinquent land for redevelopment free from liens for the unpaid taxes. The bill was signed by the Governor December 12, 2003 and the bill becomes effective March 11, 2004.
HB 145 ELECTRONIC COMMERCE SERVICES (Buehrer) Am. & En. 1306. Adopts the Electronic Government Services Act to prohibit a government agency from providing duplicative or competing electronic commerce services with the private sector, other than described cable service, unless the government agency complies with procedures established by the Act. The bill has been referred to the House State Government Committee.
HB 175 CONTRACTOR LICENSING (Buehrer) Am., En. & Rep. 307, 505, 715, 1312, 2703, 3722, 3781, 3791, 4703, 4733, 4740, 4929 & 4933. Requires statewide licensing of residential contractors, establishes a statewide uniform building code for residential buildings, establishes a process for granting variances from the statewide uniform residential building code, and makes other changes in the laws governing residential contractors and residential construction. The bill has passed the House.
HB 176 ELECTED OFFICIAL RETIREMENT NOTICE (Hoops) Am. 145. Concerning the deadline for an elected official seeking re-election to file a notice of intent to retire and continue in public office. The bill has been assigned to the House State Government Committee.
HB 179 GASOLINE THEFT (Wolpert) Am. 2913. Requires a suspension of the driver's license of a person who causes a motor vehicle to leave the premises of a retail gasoline establishment without full payment for gasoline dispensed into the motor vehicle's fuel tank or another container and declares that those sections in the Revised Code that regulate theft of gasoline in certain circumstances are general laws. The bill was signed by the Governor on December 12, 2003 and becomes effective March 9, 2004.
HB 180 TOWNSHIPS FIREARM REGULATIONS (Wolpert) En. 505. Permits a township to prohibit the discharge of a firearm in designated districts in the unincorporated area of the township. The bill has been assigned to the House Civil & Commercial Law Committee.
HB 181 ELECTED OFFICIAL SUSPENSIONS (Schaffer) En. 3 & 2961. Permits the Governor to suspend from office in accordance with a specified procedure any elected local official charged with a felony related to the official's administration of, or conduct in the performance of the duties of, the office and prohibits a person who is convicted of certain theft offenses, or any other felony or recent misdemeanor involving fraud, deceit, or theft, from holding a public office or position of public employment, or serving in certain unpaid volunteer positions, that involve substantial management or control of certain public or private property. The bill has passed the House and has been assigned to the Senate Judiciary on Criminal Justice Committee.
HB 185 LONG-TERM CARE INSURANCE (Schmidt) Am. 124 & 505. Permits the state and political subdivisions to pay some or all of the premium for their employees' long-term care insurance. The bill becomes effective August31. 2004.
HB 186 TRUCK SPEEDS (Gibbs) Am. 4511. Increases from 55 to 65 miles per hour the speed at which motor vehicles weighing more than 8,000 pounds when empty and noncommercial buses are permitted to travel on certain freeways in this state. The bill has been assigned to the House Transportation & Public Safety Committee.
HB 187 POLICE & FIRE COLA (T. Patton) Am. 742. Increases the cost of living allowance for certain Ohio Police and Fire Pension Fund members to $540 per year. The bill has been assigned to the House Banking, Pensions & Securities Committee.
HB 208 RETAINAGE PERCENTAGE (Young) Am. 153, 3791, 4113 & 5559. Modifies provisions governing the practice of withholding a percentage of payment from contractors, subcontractors, and material suppliers in the form of retainage. The bill has been voted out of committee and is awaiting a floor vote.
HB 210 MOBILE TELEPHONE USAGE (Barrett) En. 4511. Prohibits any person from operating certain vehicles while engaged in any activity that impairs the ability of the person to control fully the vehicle, prohibits any person from operating a moving vehicle and simultaneously using a mobile telephone that is not capable of being operated in a hands-free manner other than to report an emergency, prohibits without exception any person with a temporary instruction permit from operating a moving vehicle and simultaneously using a mobile telephone, and requires the State Highway Patrol to compile monthly data and statistics on motor vehicle accidents in which mobile telephone use was a material factor. HB 227 STRS BOARD (Schneider) Revises the law governing Ohio's five public retirement systems and the Treasurer of State's custodial duties. The bill has passed the Senate.
HB 256 MERGER LAW (Setzer) Am. & En. 709. Revises the Merger Law. The bill has passed the House.
HB 262 POLL WORKERS & OPTION ELECTIONS (Carmichael) Am. 3501, 3509, 3513 & 4301. Revises the Election Law by increasing the maximum poll worker pay, permitting employees of the state and of political subdivisions to work as judges of elections and receive poll worker pay in addition to their regular employment compensation, eliminating the required ballot language describing certain past local option elections when a local option election is held on sales of alcoholic beverages at a specific location, and makes other changes. The bill becomes effective May 7, 2004.
HB 278 OIL & GAS DRILLING REGULATION (Niehaus) Am. & Rep. 303, 519 & 1509. Declares that the Division of Mineral Resources Management in the Department of Natural Resources has exclusive authority to regulate the permitting, location, and spacing of oil and gas wells in the state and revises the laws governing the drilling of oil and gas. The bill becomes effective September 16, 2004.
HB 283 RETIREMENT FUND GOVERNANCE (J. Stewart) Am. 102, 145, 171, 742, 3307, 3309 & 5505. Requires state retirement system board members to file financial disclosure statements with the Ohio Ethics Commission, removes the attorney general and auditor of state from the retirement system boards, and requires the Ohio Retirement Study Council to have independent fiduciary performance audits of the state retirement systems conducted. The bill has been referred to the House Banking, Pensions & Securities Committee.
HB 289 UTILITY DEREGULATION (Hollister) En. 4928. Affirms December 31, 2005, as the termination date for the market development period of an incumbent electric utility for all its customer classes, except as authorized by current law, and declares an emergency. The bill has been assigned to the House Public Utility Committee.
HB 291 STATE MINIMUM WAGE (DeBose) Am. 4111. Increases the state minimum wage. The bill has been referred to House Commerce & Labor Committee.
HB 319 MUNICIPAL TAX ADMINISTRATORS (Raussen) Authorizes the Tax Commissioner to provide municipal income tax administrators with access to school district income tax records and returns. Am. 5703 & 5747. The bill has been referred to House Ways & Means.
HB 324 TRAFFIC LAW REVISIONS (Oelslager) Modifies and corrects errors in the Ohio Criminal Sentencing Commission's traffic law revisions and declares and emergency. The bill has been assigned to the Senate Judiciary Committee on Criminal Justice.
HB 333 MOTORIZED SCOOTERS (Miller, D.) Permits certain motorized scooters to be operated in the same manner and in the same location as motorized bicycles. The bill has been assigned to the House Transportation & Public Safety Committee.
HB 340 LABOR AGREEMENTS & PUBLIC CONTRACTS (Young) Neither requires nor prohibits any person who submits a bid on a public improvement project involving state funds to enter into or adhere to agreements with one or more labor organizations. Am. & Rep. 4116. The Bill has been assigned to the House Finance & Appropriations Committee.
HB 346 SALES TAX REPEAL (Young) Repeals the temporary sales tax increase. Am. 5732 The Bill has been assigned to the House Ways & Means Committee.
HB 381 VEHICLE TOWING FEES (Key) Establishes a procedure for a vehicle owner to obtain the release of a vehicle without payment of towing and storage fees if a law enforcement agency improperly ordered the vehicle into storage. The Bill has been assigned to the House Transportation & Public Safety Committee.
HB 386 UNIFORM BUILDING CODE (Kilbane) Specifies the building code adopted by the Board of Building Standards is a statewide uniform building code. The bill has been referred to the House Homeland Security, Engineering & Architectural Design Committee.
HB 396 CONTRACTOR LICENSING CONSTRUCTION INDUSTRY LICENSING (McGregor) Changes the name of the Ohio Construction Industry Examining Board to the Ohio Construction Industry Licensing Board and makes other changes related to that Board. The bill has been assigned to the House Homeland Security, Engineering & Architectural Design Committee.
HB 411 LAND APPROPRIATIONS (Seitz) Allows a county, municipal corporation, conservancy district, sanitary district, county sewer district, or regional water and sewer district to appropriate land without a prior jury assessment for the construction of sewers when the Director of Environmental Protection or a local board of health finds that unsanitary conditions compel the immediate construction of sewers for the protection of the public health and welfare; revises the rulemaking authority of a board of county commissioners that adopts rules governing erosion control, sediment control, and water management; establishes a penalty for violation of those rules; authorizes a board of county commissioners that has established a county sewer district to adopt rules governing the prevention of sewer back-ups; and requires health district licensing councils to meet at least annually rather than quarterly. The bill has been referred to the Senate Agriculture Committee.
HB 427 JOB DEVELOPMENT INCENTIVES (Martin) Am. 5709. Increases from 10 to 15 the number of years enterprise zones or urban jobs and enterprise zone agreements may exempt property from taxation, subject to school board approval; creates the Job Development Initiatives Fund and transfers up to $25.8 million of unclaimed funds to it, and; makes appropriations. The bill becomes effective June 9, 2004. HB 428 ADULT ENTERTAINMENT REGULATION (Reidelbach) Generally regulates adult entertainment establishments; permits townships to regulate the location and operation of those establishments; creates an expedited appeal from orders, adjudications, or decisions denying an application for, or suspending or revoking, a license or permit to locate or operate such an establishment; creates an expedited appear in any case in which a court determines there is a threat of restraint of protected expression, and; creates the offense of permitting unlawful operation of viewing booths depicting sexual conduct. Am., En. & Rep. 303, 503, 519, 2505, 2506, 2507 & 3768. The bill has passed the House.
HB 432 CONSTRUCTION DEBRIS FACILITIES (Webster) Replaces the construction and demolition debris facility license fee with a fee on the disposal of construction and demolition debris at construction and demolition debris facilities and solid waste facilities and revises the definition of "construction and demolition debris." Am., En. & Rep. 3714. The bill has been referred to the Senate Energy, Natural resources & Environment Committee.
HB 449 RETIREMENT SYSTEM REFUND (Seitz) Allows a retirant re-employed in a position covered by the Public Employees Retirement System to receive a refund of the retirant's contributions in lieu of a benefit for the period of re-employment. The bill has passed the House.
HB 455 RETIREMENT BENEFITS (Schneider) Regarding an election by a retirant of one of the state's public retirement systems who has married or remarried to change the plan under which a retirement benefit is paid. The bill has passed the House.
HB 458 MOTOR FUEL TAX DELAY (Grendell) Delays for one year the increase in the motor fuel tax that is scheduled to begin taking effec in fiscal year 2005, authorizes county auditors to establish a motor fuel quality testing program, and creates the Gasoline Practices Oversight Commission for the period ending December 31, 2005. Am. & En. 319, 1327, 5728 & 5735. The bill has been assigned to the House Ways & Means Committee.
HB 460 COURT COSTS (Key) Requires that fifty per cent of all fees paid into the Financial Responsibility Compliance Fund be distributed to the courts to cover costs incurred by the courts in connection with the enforcement of traffic laws. Am. 4503 & 4509. The bill has been assigned to the House Judiciary Committee.
HB 461 HOME IMPROVEMENTS (Trakas) Adopts the Home Improvement Contractor Law, establishes the Home Improvement Contractor Registration Board in the Department of Commerce establishes civil and criminal penalties for violation of the law and grants the attorney general enforcement powers. HB 465 RESIDENTIAL ROOFER LICENSING (Wolpert) Licenses residential roofers and siders with the Ohio Construction Industry Examining Board and prohibits residential roofers and siders from acting as public insurance adjusters or negotiating claims for an insured. Am. 715, 3781, 3951 & 4740. The bill has been assigned to the House Homeland Security, Engineering & Architectural Design Committee.
HB 466 VITAL RECORDS (Stewart, J.) Provides for the availability of uncertified copies of vital records; establishes the fee for certified copies of vital records and birth certificates in most circumstances and eliminates the additional five-dollar fee for certified copies of vital records and birth certificates. HB 468 MILITARY SERVICE CREDIT (Stewart, J.) Permits a member of the Public Employees Retirement System to purchase military service credit for inactive duty in the Ohio National Guard or reserves. HB 496 CONCEALED WEAPONS (Yates) Expands the list of "prohibited places" where a person possessing a valid license to carry a concealed handgun is not permitted to carry a concealed handgun to include public parks, swimming pools, golf courses, cemeteries, and parking lots and permits a municipal corporation to adopt an ordinance or resolution to restrict the places where a person possessing a valid license to carry a concealed handgun may carry a concealed handgun. The bill has been referred to the House Judiciary Committee.
HB 507 CONTRACTOR COMPLIANCE (Stewart, J.) Requires public authorities, contractors, and subcontractors to obtain proof of compliance with specified laws from contractors, subcontractors, and lower tier subcontractors before contracting for public improvements; prohibits the approval of building plans without proof of compliance with specified laws; and establishes criminal penalties for contractors and subcontractors who contract with subcontractors and lower tier subcontractors who violate specified laws and for employers who employ illegal aliens. Establishes the Ohio Manufactured Homes Commission to regulate the installation of manufactured housing in Ohio. The bill becomes effective August 6, 2004.

Requires the Inspector General to investigate a state retirement system at the request of the Ohio Retirement Study Council; provides for recall of state retirement system board members and makes documents regarding filling a board member vacancy open to public inspection. SB 226 EMINENT DOMAIN FEES (Padgett) Requires agencies to pay in just amounts determined by a court the attorney's fees, witness fees and other actual expenses that a property owner incurs in eminent domain proceedings if the compensation and damages that a jury assesses for the affected property exceed the agency's highest offer for the property by ten per cent or more. SB 248 MOTOR VEHICLE REMOVAL IMMUNITY (Schuler) Permits local law enforcement agencies and fire departments to remove motor vehicles from the roadway after a motor vehicle accident and provides immunity to local law enforcement agencies and fire personnel for the removal of damaged or inoperable vehicles from roadways.
